El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. Background: COVID-19 has taken many lives worldwide and due to this, millions of persons are in grief. When the grief process lasts longer than 6 months, the person is in risk of developing Complicated Grief Disorder. The CGD is related to serious health consequences. To reduce the probability of developing CGD a preventive intervention could be applied. In developing countries like Mexico, the psychological services are scarce, self-applied interventions could provide support to solve this problem and reduce the health impact (...) even after the pandemic has already finished.Aims: To design and implement a self-applied intervention composed of 12 modules focused on the decrease of the risk of developing CGD, and increasing the life quality, and as a secondary objective to reduce the symptomatology of anxiety, depression, and increase of sleep quality. The Intervention Duelo COVID follows the principles of User Experience and is designed according to the needs and desires of a sample of the objective participants, to increase the adherence to the self-applied intervention, considered one of the main weaknesses of online interventions.Methods: A Randomized Controlled Trial will be conducted from the 22nd of December of 2020 to the first of June 2021. The participants will be assigned to an intervention with elements of Cognitive Behavioral Therapy, Acceptance and Commitment Therapy, Mindfulness and Positive Psychology. The control group will be a wait-list condition, that will receive the intervention 1.5–2 months after the pre-measurement were taken. The Power Size Calculation conducted through G*Power indicated the need for a total of 42 participants, which will be divided by 21 participants in each group. The platform will be delivered through responsive design assuring with this that the intervention will adapt to the screen size of cellphones, tablets, and computers.Ethics and Dissemination: The study counts with the approval of the Research Ethics Committee of the Autonomous University of Ciudad Juárez, México, and it is registered in Clinical Trials. The article is sent and registered in clinical trials before the recruitment started. The results will be reported in future conferences, scientific publications, and media. (shrink)

Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. La presente nota crítica del libro de Juan Comesaña Being Rational and Being Right se divide en tres secciones. La sección I describe las caracteristicas fundamentales del “Experiencialismo”, que es la teoría de la racionalidad básica desarrollada y defendida a lo largo del libro; la sección II indica brevemente el contenido de los capítulos; y la sección III articula y discute una cuestión problemática acerca de cómo el Experiencialismo interactúa con el debate liberalismo/conservadurismo en la teoría de la justificación.

In this paper, I develop a problem I call the “Conditional Position Problem” that arises for Ernest Sosa’s externalist epistemology. The problem is that, due to a phenomenon of epistemic circularity, one is unable to attain the reflective knowledge that one is justified in believing that perception is reliable, and is confined to the merely conditional position that one is so justified if perception is reliable. The problem is similar but different from a problem that Barry Stroud has tried to (...) formulate. However, because of space limitations I cannot explain in detail what makes the two problems different. The structure of the paper is as follows: first, I explain the structural features of Sosa’s epistemology that allow the problem to arise; I also describe the normative task that is thwarted by the Conditional Position Problem; then I expound the problem itself. I proceed to examine one response that Sosa can give based on a simple inferential manoeuvre and explain why that response fails; then I examine another response he can give based on a complex form of self-support, and explain why this response also fails. I conclude explaining why the problem I present is specifically a problem for externalism. In an appendix, I very briefly describe what I take to be the main reason that justifies my claim that Stroud's problem is not the same as the problem I develop. (shrink)

The problem of epistemic bootstrapping requires explaining, in a principled manner, why a subject who engages in bootstrapping fails to know the conclusion of her reasoning. Existing proposed solutions to the problem provide unsatisfactory explanations regarding the bootstrapper's ignorance. This paper puts forward a novel solution and argues that it satisfactorily explains the ignorance of the bootstrapper, while avoiding the difficulties that other proposals face. Section 1 explains what epistemic bootstrapping is, defines the problem it poses for a theory of (...) knowledge, and outlines the basic desiderata demanded of any acceptable solution to the problem. Section 2 explicates the proposal I defend throughout the rest of the paper. Here, I contend that the wrong−making feature of bootstrapping which ultimately explains the bootstrapper's ignorance is a failure to use an independent source in checking the accuracy of the reports of a given source. I call this explanation the “Independence proposal.” Section 2 also argues that the phenomenon of bootstrapping is broader than is usually assumed; there are cases of bootstrapping that do not fit the superficial structure of the prototypical cases discussed in the literature, and any good proposal should apply to these as well. Section 3 argues that the independence proposal does better than other current proposals in fulfilling the desiderata identified in Section 1. Casi todo lo que nos rodea implica riesgos de algún tipo, aunque no obstante es la cultura del riesgo la que ha coadyuvado al progreso y el desarrollo de la sociedad. El principio de precaución que no es ajeno a esta realidad, responde a la incertidumbre del riesgo, sin limitarse a expresar una actitud subjetiva del miedo. Es, un medio eficaz para la protección, en todo momento y de manera oportuna, de los recursos naturales, para así alcanzar el fin de (...) las normas ambientales. Este libro colectivo constituye a través de una juiciosa recopilación de experiencias de derecho comparado, y de un diálogo en torno a las tensiones que se dan, un llamado de atención para repensar el principio de precaución. El tratamiento de estas cuestiones por parte de los autores, tuvo por norte el equilibrio entre el desarrollo de la sociedad y la salvaguarda de los derechos que podrían afectarse por una situación de riesgo inminente; siempre de cara a la rigurosidad exigida por la ciencia. Esta obra permite al lector contar con valiosas herramientas para realizar una evaluación amplia del alcance actual del principio de precaución, tema que debe tener continuidad en pro de un mejor entendimiento de la gestión del riesgo y de las complejas circunstancias de la invocación y aplicación del principio que debe estar presente en la formulación de las políticas ambientales, dado que las autoridades y los particulares ante la falta de certeza científica absoluta, para impedir la degradación ambiental, deberán darle aplicación cuando exista peligro de daño grave e irreversible como lo establece la legislación colombiana (artículo 1 Ley 99 de 1993). This paper proposes an analysis of the anti-metaphysical and anti-philosophical posture of the poetry of Alberto Caeiro, in order to show how the philosophical question for Truth is displaced by an awareness of the impossibility of signs to tell the truth, which leads to a theory of lie that allows to create a possible world, real from within. Caeiro proposes a return to the realm of the no-semiotics, the pre-logical, but uses the material he refuses: language, signs, poetry. Thus, he (...) stands on the edge of language and “embodies” the semiological project of recognize himself as a lie, a sign, a footprint without trace. By contradiction and paradox as tools of language, Fernando Pessoa, through his main heteronymous, combines philosophy and poetry, renounces the question for Truth –putting an end to the philosophical question– and deviates the unsolvable metaphysical opposition. El propósito del artículo es explicar el genocidio de la Unión Patriótica en clave de la economía nacional y su ubicación estratégica a partir de una aproximación teórica desde algunos elementos propuestos por Antonio Negri y Michael Hardt. Como conclusión se destaca que el genocidio de la up fue consecuencia de su poderío local, que ponía en riesgo la continuidad de las clases políticas dominantes en razón de sus propuestas como colectivo político. Así mismo, este hecho produjo que a raíz (...) de su origen se construyera sobre ellos un relato negativo de enemigos de la sociedad civil. Focusing on media discourse and adopting a Critical Discourse Analysis—linguistic and rhetorical—perspective, this paper explores the role of the media in influencing citizens’ behaviour towards the COVID-19 crisis. The paper evaluates the set of potentially persuasive lexical items and emotional implicatures used by two quality newspapers, i.e. The Guardian and El País, to report on the pandemic during the three waves—the periods between the onset and trough of virus contamination—that occurred until March 2021. A representative, ad-hoc, comparable corpus was compiled (...) in English and Spanish comprising the news on the pandemic that appeared in the aforementioned newspapers during the three established time periods. The corpora were uploaded to Sketch Engine, which was used to first detect and analyse different categories of word frequency, and then assign negative or positive polarity. Lexical keyness was secondly analysed to categorize emotional implicatures of control, metaphors, signals of epistemic asymmetry and positive implicatures in order to discern how they become weapons of negative or positive persuasion. The ultimate end of the study was to critically analyse and contrast the lexicon and rhetoric used by these two newspapers during this time period so as to unveil the stance taken by governments and health institutions—voices of authority—to disseminate words of control and persuasion with the aim of exerting influence on the behaviour of citizens in UK and Spain. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

Los valores cristianos son ahora más relevantes debido a que las empresas no se preocupan solo del beneficio. mediante una muestra de 176 empresas de la zona 4 de Ecuador, se ha estudiado la aplicación de los valores de solidaridad, honestidad, humildad y responsabilidad en los procesos productivos y de contratación de personal. El objetivo es averiguar si estos valores son relevantes en la gestión. Como resultado se encontró que existen pocas empresas que tengan en cuenta estos valores declarados como (...) tal. La ausencia de estos valores indica que las empresas deben incorporarlos para tener mayor sostenibilidad y responsabilidad social. (shrink)

BackgroundPaternalism/overprotection limits communication between healthcare professionals and patients and does not promote shared therapeutic decision-making. In the global north, communication patterns have been regulated to promote autonomy, whereas in the global south, they reflect the physician’s personal choices. The goal of this study was to contribute to knowledge on the communication patterns used in clinical practice in Mexico and to identify the determinants that favour a doctor–patient relationship characterized by low paternalism/autonomy.MethodsA self-report study on communication patterns in a sample of (...) 761 mental healthcare professionals in Central and Western Mexico was conducted. Multiple ordinal logistic regression models were used to analyse paternalism and associated factors.ResultsA high prevalence (68.7% [95% CI 60.0–70.5]) of paternalism was observed among mental health professionals in Mexico. The main determinants of low paternalism/autonomy were medical specialty (OR 1.67 [95% CI 1.16–2.40]) and gender, with female physicians being more likely to explicitly share diagnoses and therapeutic strategies with patients and their families (OR 1.57 [95% CI 1.11–2.22]). A pattern of highly explicit communication was strongly associated with low paternalism/autonomy (OR 12.13 [95% CI 7.71–19.05]). Finally, a modifying effect of age strata on the association between communication pattern or specialty and low paternalism/autonomy was observed.ConclusionsAmong mental health professionals in Mexico, high paternalism prevailed. Gender, specialty, and a pattern of open communication were closely associated with low paternalism/autonomy. Strengthening health professionals’ competencies and promoting explicit communication could contribute to the transition towards more autonomist communication in clinical practice in Mexico. The ethical implications will need to be resolved in the near future. (shrink)

As the world keeps advancing, the need for automated interconnected devices has started to gain significance; to cater to the condition, a new concept Internet of Things has been introduced that revolves around smart devicesʼ conception. These smart devices using IoT can communicate with each other through a network to attain particular objectives, i.e., automation and intelligent decision making. IoT has enabled the users to divide their household burden with machines as these complex machines look after the environment variables and (...) control their behavior accordingly. As evident, these machines use sensors to collect vital information, which is then the complexity analyzed at a computational node that then smartly controls these devicesʼ operational behaviors. Deep learning-based guessing attack protection algorithms have been enhancing IoT security; however, it still has a critical challenge for the complex industries’ IoT networks. One of the crucial aspects of such systems is the need to have a significant training time for processing a large dataset from the networkʼs previous flow of data. Traditional deep learning approaches include decision trees, logistic regression, and support vector machines. However, it is essential to note that this convenience comes with a price that involves security vulnerabilities as IoT networks are prone to be interfered with by hackers who can access the sensor/communication data and later utilize it for malicious purposes. This paper presents the experimental study of cryptographic algorithms to classify the types of encryption algorithms into the asymmetric and asymmetric encryption algorithm. It presents a deep analysis of AES, DES, 3DES, RSA, and Blowfish based on timing complexity, size, encryption, and decryption performances. It has been assessed in terms of the guessing attack in real-time deep learning complex IoT applications. The assessment has been done using the simulation approach and it has been tested the speed of encryption and decryption of the selected encryption algorithms. For each encryption and decryption, the tests executed the same encryption using the same plaintext for five separate times, and the average time is compared. The key size used for each encryption algorithm is the maximum bytes the cipher can allow. To the comparison, the average time required to compute the algorithm by the three devices is used. For the experimental test, a set of plaintexts is used in the simulation—password-sized text and paragraph-sized text—that achieves target fair results compared to the existing algorithms in real-time deep learning networks for IoT applications. BackgroundThis study analyzed the difference in psychological distress of the healthcare workers in three different periods of the coronavirus disease 2019 (COVID-19) pandemic in Argentina. Specifically, from the third week of the mandatory quarantine through the two following weeks.MethodsAnalysis of the responses of 1,458 members of the health personnel was done on a questionnaire on healthcare workers concerns regarding the care of patients with coronavirus, indicators of depression, anxiety, intolerance of uncertainty, and coping.ResultsThe psychological indicators that were considered presented differences (...) between the evaluated periods. Perceived concerns about the possibility of infecting loved ones and infecting themselves were greatest in the periods after the onset of the pandemic. In addition, the perception of how the work environment worsened and how lack of sleep interfered with their work was also higher in periods 2 and 3. The same results were found in the indicators of depression, anxiety, and intolerance of uncertainty. Finally, the indicators of high tension and concurrent lack of emotional control, which was greater in the last periods evaluated, were also expressed in the coping strategies (showing emotional lability, only contained by hypercontrol).ConclusionThe differences found in the psychological indicators between the evaluated periods support the need for early psychological care of health personnel which should be a priority of public health and a fundamental fact to increase its immediate effectiveness in the care of infected patients. It is sometimes claimed that we perceive people’s mental states in their expressive features. This paper clarifies the claim by contrasting two possible readings, depending on whether expression is conceived relationally or non-relationally. A crucial difference between both readings is that only a non-relational conception of expression ensures direct access to other minds. The paper offers an argument for a non-relational conception of expression, and therefore for the view that we directly perceive people’s mental states in their expressive features.

This paper claims that we have direct and complete perceptual access to other people’s emotions in their bodily and behavioural expression. The claim is understood, not by analogy with the perception of three-dimensional objects or physical processes, but as a form of Gestalt perception. In addition, talk of direct perceptual access to others’ emotions is shown not to entail a behaviourist view of mind; and talk of complete perceptual access is shown to include both the phenomenological character and the dispositional (...) nature of emotions. Background The COVID-19 pandemic has influenced the approach to the health-disease system, raising the question about the principles of bioethics present in physician–patient relations. The principles while widely accepted may not be sufficient for a comprehensive ethical analysis. Therefore, the aim of this study was to explore the perception of these principles and the physician–patient relationship during a hospital stay through a qualitative approach. Method Sixteen semi-structured interviews took place to know the patients’ perception during their 2020 hospitalization for COVID-19. (...) The data was analyzed through the constant comparison method, creating categories and comparing them. In the end, seven categories were established and were grouped in three: bioethical principles (dignity, charity, vulnerability, autonomy), doctor-patient relationship (participant commitment, informed consent, health staff-patient relationship) and the experience of the disease (illness, the role of the family). Results The research found that most patients described a positive experience, with the feeling of having been well cared for with no sense of discrimination or injustice done. The majority also reported that their autonomy was respected in the treatment decisions. The evaluation of these attitudes is an area of opportunity, especially when the patients' vulnerability is at risk. Conclusions The ethics of virtue offers a better reflection of how human beings manifest themselves by emphasizing the development of virtuous character and behaviors that allow them to realize their values in life. The assembly of products or components by operators in industries is a complex task with recurring problems. In these processes, operators often make errors that can lead to defective products. Therefore, they need to be inspected later to verify their correct assembly. The main problems are caused by several reasons including high employee turnover, lack of experience in manufacturing specific products or confusion in interpreting instructions to assemble similar components. In this paper, a novel structured language aimed to describe the (...) required actions to manufacture a product in industrial assembly environments is presented. The main contribution is to provide a formal language to feed automatic systems that can verify through visual control whether the actions performed by the operator are carried out following the standard described by this language. In general, the use of this formal language will allow to minimize the negative impact of errors during assembly and to reduce waste in many forms in the industry. (shrink)

Contemporary literature distinguishes two ways to defend the claim that cognition is a matter of representations: one, cognition involves representation-hungry tasks; two, cognition involves a complex form of informational covariation between subcomponents of a system with an adaptive function. Each of these conceptions involves a different notion of representation, and promotes a particular view of the architecture of cognition. But despite the differences, each of them aims to support the claim that cognition is a matter of representations on architectural constraints. (...) The objective of this article is twofold: one, it is argued that architectural constraints do not entail either of those two ways to defend the claim that cognition is a matter of representations; two, it is claimed that both notions of representation share an objectionable common element – namely, the idea of a model that grounds the representational reading– that must be abandoned, in favor of a more economical explanation in terms of causal relations, in order to get a clear view of cognition. This paper defends a Wittgenstein-inspired conception of the nature of mind and self-knowledge. Thus, it is claimed that the mind is to be conceived as expressive behaviour; and that knowledge of one’s own mind is not to be thought of as a matter of first-person access, i.e. a special sort of access available to oneself alone, but rather as a matter of ordinary access, similar to other people’s. It is also argued that this conception does not undermine the distinctness of (...) the first-person perspective, including the asymmetry with the third-person perspective, which should be construed semantically, rather than epistemically. As a result, an alternative to contemporary conceptions of mind and self-knowledge is provided. (shrink)

The research on the information system and emotional intelligence in the corporate social responsibility of criminal justice modules in Piura 2023 analyses how the information system and emotional intelligence influence corporate social responsibility. The study, of a quantitative and explanatory nature, was carried out with a sample of 100 collaborators of the Criminal Justice Modules of Piura. Using questionnaires and ordinal logistic regression analysis, it was found that both emotional intelligence and an effective information system are essential to improve corporate (...) social responsibility in these modules. The research concludes that the development of emotional and technological capabilities is crucial to foster a more responsible and effective organizational environment. (shrink)

There are 2 main problems with the current periodic table: artificial breaks from a given noble gas to the next alkali metal (along with the common protrusion of the “f” block) and hydrogen placed in the alkali group, although this gas also exhibits halogen properties. This paper proposes arranging chemical elements in a square spiral with hydrogen at the centre. This element is also above lithium but passes above fluorine to connect with helium, representing its dual alkali and halogen nature (...) effectively. Then the spiral moves outwards in a counter-clockwise direction, avoiding artificial breaks and following the natural direction of reading for the “s” and “p” blocks elements placed at the bottom of the spiral. Furthermore, this proposed square spiral improves upon previous Janet´s and Benfey´s representations with a more regular shape to draw, an effective depiction of the dual nature of hydrogen, and easily identifiable orbital blocks without the need for protrusions. Ideally, decisions regarding one’s health should be made after assessing the objective probabilities of relevant outcomes. Nevertheless, previous beliefs and emotional reactions also have a role in decision-making. Furthermore, the comprehension of probabilities is commonly affected by the presentation format, and by numeracy. This study aimed to assess the extent to which the influence of these factors might vary between different medical conditions. A sample of university students were presented with two health scenarios containing statistical information on the prevalence of (...) breast cancer and hypertension either through icon arrays ( N = 71) or natural frequencies ( N = 72). They also received information regarding a preventive measure (mammogram/low-sodium diet) and the likelihood of a positive mammogram or a rich-sodium diet either when suffering or not suffering from the disease. Before seeing the data, participants rated the severity of the disease and the inconvenience of the preventive measure. After reading the health scenario, participants had to rate its difficulty, and how worrisome it was. They had also to rate the prior probability of suffering from this medical condition, and the posterior probability of it, provided a positive mammogram or a rich-sodium diet. Finally, they rated the extent to which they would recommend the preventive measures. All the rates used the same 1 (little)-8 (a great deal) scale. Participants’ numeracy was also assessed. The scenarios differed significantly in perceived severity and worry, with the cancer scenario obtaining higher scores. Importantly, regression analyses showed that the recommendations in the two health scenarios depended on different variables. A model taking into consideration severity and worry rates best explained decisions in the cancer scenario; in contrast, in the hypertension scenario the model that best explained the recommendations comprised both the posterior probability estimate and the severity rate. Neither numeracy nor presentation format affected recommendation but both affected difficulty, worrying and probability rates. We conclude that previous perceptions of the severity of a health condition modulate the use of probabilistic information for decision-making. The roles of presentation format and numeracy in enabling patients to understand statistical information are also discussed. (shrink)
